An update for the Canadian Pacific Railway Limited

Update: March 22, 2022

We have received the latest update on the Canadian Pacific Railway situation. The Teamsters Canada Rail Conference (TCRC) Negotiating Committee has agreed to enter into binding arbitration with Canadian Pacific (CP), ending the TCRC strike action that began over the weekend. Workers will return to work at noon local time on Tuesday, March 22 allowing CP to execute a safe and structured start-up of its train operations. As mentioned on our update below, Detention and Demurrage will be waived for the impacted containers, only for the duration of the strike (March 21 and 22, 2022 inclusively). The remaining guidelines mentioned on the previous update are still in effect until further notice

Update: March 21, 2022

On March 20, 2022, the Canadian Pacific Railway announced that they are executing a safe and structured shutdown of its train operations across Canada and will work closely with customers to wind-down Canadian operations. This is caused by the Teamsters Canada Rail Conference (TCRC) strike.

With your cargo planning in mind, please refer to the following guidelines for our bookings:

• Export containers are still being accepted across all CP Ramps with the exception of Schiller Park. Please note that once a container is returned to the ramp, it will remain at the ramp until rail service is resumed. This means that regretfully, you will not be able to pick it back up. For export containers that have already been picked up and cannot be gated-in, we will not charge detention.
• Rail ramps will remain open for pick up of Import containers. Customer will be responsible for standard storage charges directly with CP/Terminal Operators as per their policy.
• Diversions of containers already grounded at the marine terminals will not be possible at this time.
• Detention and Demurrage (DID inland and DMD port) will be waived for the impacted containers, only for the duration of the strike. Demurrage and Detention Free time will be extended by the number of impacted/closure days.

Update: March 18, 2022

On March 16, 2022 Canadian Pacific Railway Limited issued a 72-hour notice to the Teamsters Canada Rail Conference (TCRC). This notice included its plan to lock-out employees at 00:01 a.m. ET on Sunday, March 20, 2022 if the union leadership and the company are unable to come to a negotiated settlement.

At the moment of this update, operations continue as normal for both Import and Export cargo across CP’s network. Negotiations between the two parties are expected to continue over the course of the next few days in an effort to reach a new negotiated collective agreement in hopes of avoiding a labor disruption.
