China – Misdeclaration Fee
Hapag-Lloyd will implement a penalty of USD 1,250 per container for misdelcaration of cargo and misuse of contract after a booking is confirmed by Hapag-Lloyd.
The penalty shall apply, but not limited to the following circumstances:
- Mis-declaration of commodity and any Bill of Lading information that deviates from the contractual agreement with Hapag-Lloyd;
- Misuse of contract detected, where the shipment and Bill of Lading information deviates from the contractual agreement with Hapag-Lloyd and/or contracted rate is applied for an unrelated account without prior consent from Hapag-Lloyd
Hapag-Lloyd reserves the right to recover the penalty fee and the Freight All Kind (FAK) tariff rate at the time of the shipment from responsible parties for mis-declared and contract misused shipments.
The penalty fee of USD 1,250 per container applies to export trades for all cargo from China, Hong Kong and Taiwan from 1 July 2021.
