We would like inform you on an update to the Hong Kong law regarding conveyance and stowage of a part of motor vehicle that has fuel in its fuel tank and a new policy of our terminal operating under The Hong Kong Seaport Alliance (HKSPA). Pursuant to Section 17 of the Regulation, it is an offence if a person knowingly causes/ permits to be conveyed on land or conveys on land a container that contains a part of a motor vehicle that has fuel in its fuel tank or is otherwise stained with fuel, unless the container is open at the top or is well ventilated.
Section 18 of the Regulation states that it is an offence if a person knowingly causes/permits to be stowed or knowingly stows in a container that is or is to be conveyed on land a part of a motor vehicle that has fuel in its fuel tank or is otherwise stained with fuel, unless the container is open at the top or is well ventilated.
As a gentle reminder, if a part of motor vehicle that has fuel in its fuel tank or is otherwise stained with fuel is to be conveyed on land, customers are reminded to use a container that is open at the top or well ventilated.
Below are some of the examples of containers that are NOT classified as open at the top or well ventilated. They are classified as “general purpose container without ventilation”, under the ISO Container Size Type. (Please note that this is not an exhaustive list.)
As a responsible terminal, we will strictly adhere to the above Regulation. PLEASE NOTE THAT our terminal operating under the HKSPA will have the following policy in place with effect from 1st March 2021:
1. We will not handle or release any containers for conveyance on land (i.e. including roadside delivery and internal terminal transfer shuttling) which may result in contravention of Section 17 of the Regulation; and
2. We will not perform any packaging/stowage for any containers which may result in contravention of Section 18 of the Regulation.
