Please be reminded that according to FMC Regulations, Intermediaries that wish to act as an NVOCC for FMC-related shipments will need to comply with the relevant legal requirements. This includes maintaining a public tariff and holding a valid bond. For U.S-based entity, a license is also required.

It is the responsibility of the NVOCC contract party to ensure that all bookings placed to USA and/or under the FMC regulated scope meet the requirements of the FMC. For any bookings placed without fulfilling FMC’s regulations, Hapag-Lloyd reserves the right to implement a penalty fee for mis/non-declaration of cargo. In addition, all additional costs, risks and liabilities related to the storage or movement of the cargo will be on the account of the cargo owner.
