Canadian Pacific Railway Limited – Labour Update #3

Further to our Customer Info of May 29, 2018, we take this opportunity to provide further updates as of today.

CP has since issued two Customer Station Bulletins.

The first Bulletin issued advising that CP is from and since 2200 May 29, 2018, experiencing events of Force Majeure as a result of the withdrawal of labour services by members of the Teamsters Canada Rail Conference (TCRC) - Train & Engine. Given the work stoppage by the TCRC, CP has advised that it is implementing a full shutdown of its operations in Canada.

The second Bulletin issued advising that CP and the Teamsters Canada Rail Conference (TCRC) - Train & Engine have come to a resolution. The railroad is planning to be fully operational at 2300 May 30, 2018.
Please note that this has been a fluid situation and the above noted conditions are subject to change without notice. Hapag-Lloyd is monitoring and assessing the situation constantly and we will continue to use our best efforts to send updates as the situation evolves.

This notice is written without prejudice to the terms and conditions contained in the relevant underlying contracts of carriage as evidenced by Hapag-Lloyd AG’s standard Bill of Lading and/or Sea Waybill and the Hapag-Lloyd Tariff applicable thereto and/or any other applicable agreement governing the carriage of the subject cargo, as the case may be, all of which said terms and conditions continue to remain in full force and effect without any modification or waiver.
